Modern Fold legal

Terms for notes you own.

These terms describe the basic agreement for using Fold: create responsibly, keep control of your content, and review optional AI output before relying on it.

Short version You own your notes, Fold provides tools for organizing and exporting them, and optional provider-dependent features may have their own terms.

Eligibility and acceptance

By downloading, accessing, or using Fold, you agree to these Terms. If you use Fold for an organization, you represent that you have authority to accept these Terms for that organization.

Fold is not intended for children under 13. If you are under the age of majority where you live, you may use Fold only with permission from a parent or guardian who agrees to these Terms.

Using Fold

Fold helps you create structured notes, folders, schemas, checklists, reminders, backups, and exports. Subject to these Terms, Fold gives you a personal, limited, non-exclusive, non-transferable license to use the app for lawful purposes.

You may not misuse Fold, interfere with the service, attempt to bypass security, reverse engineer protected parts of the app except where law allows, upload malicious content, infringe others' rights, scrape or abuse Fold-operated services, or use Fold to violate law.

Your use of app marketplaces, operating systems, identity providers, cloud storage, and AI providers is also subject to the terms and policies of those third parties.

Your content

You keep ownership of the notes, schemas, images, checklist items, and other content you create in Fold. You grant Fold the limited rights needed to store, display, process, back up, export, sync, transmit, and otherwise operate the features you choose.

This license ends when the relevant content is deleted from Fold-operated systems, except where retention is required for legal, security, backup, or dispute-resolution reasons. You are responsible for your content, for making sure you have the rights to use it, and for keeping independent copies of anything important.

Fold intellectual property

Fold, including its app design, website, names, logos, artwork, software, and documentation, is protected by intellectual property laws. These Terms do not transfer ownership of Fold's intellectual property to you.

If you send ideas, feedback, bug reports, or suggestions, Fold may use them without restriction or compensation to you, while you keep ownership of any note content included in that feedback.

AI features

AI features are optional and may depend on third-party providers. Your prompts, selected note content, context, and outputs may be handled by the provider you configure. Provider terms and policies apply to provider-connected features.

AI output can be inaccurate, incomplete, or inappropriate. You are responsible for reviewing AI output before relying on it. Fold should not be used as the sole source for legal, medical, financial, safety, employment, housing, credit, education, insurance, or other high-stakes decisions.

Backups, exports, and recovery

Fold provides tools intended to help you back up, restore, and export data. You are responsible for storing recovery keys, passwords, backup bundles, and exported files securely.

Fold cannot recover data that exists only in files, devices, accounts, or keys you control and lose. Test restores and keep independent copies of important data.

Beta and availability

Some Fold features may be experimental, beta, provider-dependent, or available only on certain devices or operating systems. Fold may change, suspend, limit, or discontinue features, including beta features, at any time.

Beta features may contain bugs, lose data, or behave differently across releases.

Disclaimers and limits

Fold is provided "as is" and "as available" to the fullest extent permitted by law. Fold disclaims warranties of merchantability, fitness for a particular purpose, non-infringement, availability, accuracy, and error-free operation.

To the fullest extent permitted by law, Fold will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, lost goodwill, service interruption, provider outages, or device failures. Fold's total liability for claims relating to the app or these Terms will not exceed the greater of the amount you paid to Fold for the app or services in the 12 months before the claim, or 100 USD.

Some jurisdictions do not allow certain warranty disclaimers or liability limitations, so parts of this section may not apply to you. Nothing in these Terms limits rights that cannot be limited by law.

Termination, changes, and disputes

You may stop using Fold at any time. Fold may suspend or terminate access if you materially violate these Terms, create risk for the service or other users, or if required by law.

We may update these Terms as Fold changes. If changes are material, we will make reasonable efforts to provide notice through the website, app, or other appropriate channels. Continued use after the effective date means you accept the updated Terms.

These Terms are governed by the laws of the United States and the laws of the state where Fold's operator is primarily located, without regard to conflict-of-law rules. If a dispute cannot be resolved informally, it will be handled in the courts with jurisdiction over that operator, unless applicable consumer law gives you a right to bring claims elsewhere.
