Who is making this agreement

These Terms of Use are an agreement between you and the operator of the Fold app and website. “Fold,” “we,” and “us” mean that operator. “You” means the person using Fold and any organization that person is authorized to represent.

By downloading, accessing, or using the Fold app, website, public TestFlight beta, support, or Fold-operated services, you agree to these Terms and the Privacy Policy. If you do not agree, do not use Fold.

Eligibility

You must be at least 13 to use Fold. If you are under the age of legal majority where you live, you may use Fold only with permission from a parent or guardian who agrees to these Terms. You may not use Fold if applicable law prohibits you from receiving the service.

If you use Fold for a business or other organization, you confirm that you have authority to accept these Terms for it. That organization is responsible for your use and for the use of anyone it authorizes.

The license to use Fold

Fold gives you a limited, personal, revocable, non-exclusive, non-transferable license to use the app and website for lawful purposes under these Terms. The license is for object-code use of the app on Apple-branded devices that you own or control, subject to the App Store Usage Rules, including permitted Family Sharing where applicable.

Fold may offer different features by device, operating-system version, country, beta status, or plan. Buying or downloading Fold does not transfer ownership of the app or its intellectual property to you.

Device security

Fold is local-only and does not offer a Fold account or cloud sync in the current release. You are responsible for protecting your device, Apple Account, recovery material, backups, and exports. You are also responsible for activity carried out through accounts or devices you control, except to the extent caused by Fold's breach of law or these Terms.

Tell support promptly if you believe a Fold backup, export, or device has been compromised. Fold may require reasonable verification before acting on a privacy request.

Acceptable use

Use Fold lawfully and respect other people's rights. You may not:

• use Fold to break the law, violate a court order, or infringe privacy, intellectual-property, publicity, confidentiality, or other rights;
• store, send, or generate malware, unlawful threats, exploitation material, or content intended to harm people or systems;
• interfere with, overload, probe, scan, scrape, or bypass security, rate limits, access controls, or technical protections for Fold-operated services;
• access Fold-operated systems or data without permission;
• reverse engineer, decompile, or attempt to extract source code except to the limited extent applicable law expressly allows despite this restriction;
• resell, rent, sublicense, copy, or distribute Fold except as expressly allowed by these Terms or the App Store Usage Rules;
• use automated means to abuse the beta, support, AI, or other Fold-operated services; or
• misrepresent your identity, authority, affiliation, or the source of content.

Fold may investigate suspected misuse and may preserve or disclose relevant information when allowed by the Privacy Policy and law.

Your content

You keep ownership of notes, fields, images, checklists, prompts, exports, and other content you create or provide. You are responsible for that content and for having the rights and permissions needed to store, process, export, or share it.

Content stored only on your device is not licensed to Fold merely because you use the app. When you choose a feature that sends content to Fold or a provider—for example support, a future hosted service, or cloud AI—you give Fold a limited, worldwide, non-exclusive, royalty-free license to host, copy, transmit, format, and process that content only as reasonably needed to provide the feature, protect the service, follow your instructions, and comply with law.

This license ends when the content is no longer reasonably needed for those purposes, subject to the retention rules in the Privacy Policy and copies controlled by third parties. Fold does not claim ownership of your note content.

Privacy

The Privacy Policy explains what stays on your device, what information Fold receives, and how connected providers handle information. By using a connected feature, you direct the app to send the information described for that feature. Do not use Fold for information that you are not permitted to process or that requires safeguards Fold has not agreed in writing to provide.

AI features

AI writing and schema suggestions are marked Coming soon and are unavailable in the current release. Fold will update these Terms and the Privacy Policy before enabling a managed cloud AI service.

AI output may be inaccurate, incomplete, biased, offensive, outdated, or too similar to existing material. Review every suggestion before applying, publishing, or relying on it. You are responsible for how you use the output and for checking any facts, rights, permissions, and professional requirements.

Do not use Fold or AI output as the only basis for legal, medical, financial, safety, employment, housing, credit, education, insurance, emergency, or other high-stakes decisions. Fold does not provide professional advice and does not guarantee that AI output is unique, accurate, or fit for your purpose.

Backups, exports, and data loss

You are responsible for keeping independent, current backups of important content. Fold's backup, restore, Recently Deleted, history, and export tools are aids, not a guarantee against loss.

Protect backup files, exports, passwords, and recovery keys. An encrypted backup may be permanently unreadable if you lose its recovery key. An unencrypted export may be readable by anyone who gains access to it. Test that important backups can be restored before relying on them.

Fold cannot recover content that remains only on a lost, damaged, erased, or inaccessible device, account, backup, export, or key. To the extent permitted by law, Fold is not responsible for loss caused by device failure, operating-system behavior, provider failure, user error, forgotten keys, corrupted files, or failure to maintain a usable independent backup.

Subscriptions, billing, and refunds

Purchases are unavailable in the current release. Fold may later offer free and paid plans. Before any purchase, the purchase screen will show the plan name, current price, billing period, included features, and any trial. Prices and features may vary by country and may change as allowed by law and App Store rules.

A Fold subscription purchased through Apple is billed to your Apple Account. It renews automatically for the same period unless you cancel at least 24 hours before the current period ends. Apple may charge the renewal within 24 hours before the end of the period. You can manage or cancel the subscription in your App Store account settings. Deleting Fold or deleting local app data does not cancel a subscription.

Trials convert to a paid subscription unless canceled before the trial ends. Any unused part of a trial may be lost when you purchase a subscription where Apple permits. Apple handles billing, taxes, cancellation, and refunds under its rules. Except where law requires otherwise, Fold does not provide separate refunds for App Store purchases.

If a subscription ends, Fold may limit access to paid features. Fold will not intentionally hide or delete existing local notes solely because a subscription ends, but you may be unable to create additional paid-only items or use paid services. Features advertised as future or coming soon are not included until they are actually released.

Third-party services

Fold can interact with Apple, email, TestFlight, the App Store, storage locations, and other services you choose. Their terms, privacy policies, fees, limits, and availability apply in addition to these Terms. Fold is not responsible for a third party's service, content, security, changes, outage, or decision to suspend your account.

Links to third-party sites are provided for convenience and do not mean Fold endorses everything on those sites. You are responsible for reviewing a service before sending it content or credentials.

Beta builds and availability

Fold may offer prerelease versions through TestFlight. Beta software is unfinished. It may contain bugs, change without notice, perform differently across releases, or cause loss or corruption of data. Do not rely on a beta as the only place to keep important information.

Fold may add, change, limit, suspend, or discontinue features or access. Some features require a supported device, a newer iOS version, permission, network access, provider account, paid plan, or available third-party service. Fold does not promise a release date, uninterrupted access, or that every feature will remain available.

Fold will use reasonable care when changing paid services, and nothing in this section removes refund or consumer rights that cannot legally be limited.

Fold's intellectual property and feedback

Fold's software, design, website, names, logos, artwork, documentation, and other materials are owned by Fold or its licensors and are protected by intellectual-property laws. Except for the limited license above, no right in Fold's intellectual property is granted to you.

If you voluntarily send feedback, ideas, suggestions, or bug reports, Fold may use them without restriction or payment. This permission does not transfer ownership of private note content that happens to appear in feedback. Remove or cover private content before sending screenshots or examples.

Suspension and termination

You may stop using Fold at any time. You can remove local data through the app and cancel a subscription through Apple. Removing the app or local data does not cancel an active subscription or delete copies held by another service.

Fold may suspend or end access to a Fold-operated service if you materially or repeatedly violate these Terms, create legal or security risk, abuse the service, fail to pay an applicable charge, or if suspension is required by law or a provider. When reasonable, Fold will give notice and a chance to fix the problem.

Sections that by their nature should continue—such as ownership, payment obligations, disclaimers, liability limits, indemnity, and dispute terms—survive termination.

Disclaimers

To the fullest extent permitted by law, Fold is provided “as is” and “as available.” Fold does not promise that the app, website, beta, connected services, backups, exports, search, reminders, AI output, or other features will be uninterrupted, secure, accurate, complete, error-free, compatible with every device, or free from data loss.

To the fullest extent permitted by law, Fold disclaims implied warranties of merchantability, fitness for a particular purpose, quiet enjoyment, title, and non-infringement, and warranties arising from course of dealing or usage of trade. No statement outside these Terms creates a warranty unless Fold expressly says so in writing.

Some places do not allow certain warranty exclusions. In those places, the exclusions apply only to the extent the law permits. Nothing in these Terms limits a consumer guarantee or other right that cannot legally be waived.

Limits on liability

To the fullest extent permitted by law, Fold and its owners, officers, employees, contractors, affiliates, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages; loss of profits, revenue, business, opportunity, goodwill, or data; cost of replacement services; service interruption; device failure; provider outage; or unauthorized access that Fold could not reasonably prevent.

To the fullest extent permitted by law, the total liability of Fold and those parties for all claims arising from or related to Fold or these Terms will not exceed the greater of: (a) the amount you paid to Fold through the App Store for the relevant service during the 12 months before the event giving rise to the claim, or (b) US$100.

These limits apply regardless of the legal theory and even if Fold was told that a loss was possible. They do not apply to fraud, willful misconduct, gross negligence, death or personal injury caused by negligence, or any liability that law does not allow Fold to limit. Some jurisdictions do not allow certain exclusions or limits, so part of this section may not apply to you.

Indemnity

To the extent permitted by law, if you use Fold for a business or organization, that organization will defend and indemnify Fold and its owners, officers, employees, contractors, affiliates, and licensors against third-party claims, damages, losses, and reasonable legal costs arising from the organization's content, unlawful use of Fold, or material violation of these Terms.

If you use Fold as an individual consumer, you are responsible for losses Fold reasonably incurs because of your intentional unlawful conduct, infringement of another person's rights, or material breach of these Terms, but only to the extent permitted by applicable consumer law.

Governing law and disputes

Before filing a formal claim, email legal@hellofold.app with a short description of the dispute and the resolution you want. Each side will try in good faith to resolve the matter for at least 30 days. This does not stop either side from seeking urgent relief or filing in small-claims court, and it does not shorten a legal filing deadline.

These Terms are governed by the laws of the United States and the laws of the state where Fold's operator is primarily located, without regard to conflict-of-law rules. State and federal courts with jurisdiction over that operator will have jurisdiction, unless the law where you live gives you mandatory consumer protections or the right to bring a claim elsewhere.

These Terms do not require arbitration or waive participation in a class action.

Apple terms

Apple is not a party to these Terms and is not responsible for Fold or its content. Fold, not Apple, is responsible for providing maintenance and support required by law or these Terms. If Fold fails to meet an applicable warranty, you may notify Apple, and Apple may refund the purchase price paid for the app, if any; to the maximum extent permitted by law, Apple has no other warranty obligation for Fold.

Fold, not Apple, is responsible for addressing claims about the app, including product-liability claims, legal or regulatory claims, and claims under consumer-protection or privacy law. Fold is also responsible for investigating and resolving a claim that the app infringes a third party's intellectual-property rights.

You confirm that you are not located in a country subject to a United States government embargo and are not on a United States government list of prohibited or restricted parties. You must comply with applicable third-party terms when using Fold. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce this section against you.

Changes to Fold or these Terms

Fold may update these Terms when the product, business, providers, or law changes. The revised Terms will be posted with a new effective date. For a material change, Fold will provide reasonable advance notice in the app, on the website, or by email when required.

Changes apply from the stated effective date. If you continue using Fold after that date, you accept the updated Terms. If you do not agree, stop using Fold and cancel any subscription. Changes will not retroactively reduce rights for a dispute that arose before the new Terms unless the law permits and you expressly agree.

General terms

These Terms and the Privacy Policy are the entire agreement about Fold unless a separate written agreement says otherwise. If a court finds one provision unenforceable, the rest remains in effect and the provision will be enforced as far as the law allows.

A delay in enforcing a provision is not a waiver. You may not transfer these Terms without Fold's written consent. Fold may transfer them as part of a reorganization, financing, merger, acquisition, or sale of the business or relevant assets.

Fold is not liable for delay or failure caused by events beyond its reasonable control, including natural disasters, war, terrorism, labor disputes, government action, internet or utility failure, provider outage, epidemic, or failure of Apple platform services.

Headings are for readability. “Including” means “including without limitation.” Electronic notices satisfy any requirement that a communication be in writing where law allows.
